Introduction
These Terms and Conditions govern your use of GiveT, an online ticketing and event management platform operated by Byve Australia Pty Ltd . By creating an account or accessing the GiveT website, mobile application or associated services collectively the Platform you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Platform.
Variation of Terms
GiveT may amend these Terms and Conditions at any time by publishing an updated version on the Platform. Any updated terms apply immediately to all future use of the Platform. Continued use after any change constitutes acceptance of the updated Terms.
Eligibility and Account Creation
1. Any individual may register for a GiveT account regardless of age.
2. Some events listed on GiveT may require the buyer or attendee to be at least eighteen years old, particularly where alcohol or legally restricted content is involved.
3. You must provide accurate, complete and current information when creating an account.
4. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
5. GiveT may suspend, restrict or terminate any account where GiveT reasonably believes misuse, fraud, unlawful activity or a breach of these Terms has occurred.
Use of the Platform
1. You must use the Platform lawfully and only for its intended purpose.
2. You must not:
  - engage in illegal, harmful, abusive or fraudulent conduct
  - circumvent security features or attempt to gain unauthorised access
  - scrape, harvest, copy, or collect data using automated tools
  - upload or transmit unlawful, misleading, defamatory, offensive or infringing content
  - interfere with the operation of the Platform or another user’s use of it.
Platform Role
GiveT provides technology services enabling event organisers to list events and enabling users to purchase or register for tickets. GiveT is not responsible for the organisation, delivery, safety, legality or quality of any event.
Privacy and Personal Data
1. GiveT collects and manages personal information in accordance with its Privacy Policy.
2. GiveT does not store full payment card details. Payment processing is performed by PayPal or other authorised third-party providers.
3. You consent to the sharing of your information with event organisers whose events you register for or purchase tickets to.
Intellectual Property
All software, content, graphics, trademarks and materials made available through the Platform are owned by or licensed to GiveT. You are granted a limited, non-exclusive, revocable licence to use the Platform for legitimate personal or business purposes. You must not reproduce, distribute, modify or sell any part of the Platform.
Service Interruptions and Errors
GiveT does not guarantee uninterrupted access, error-free performance or security of the Platform. Maintenance, outages or technical issues may occur. GiveT is not liable for any resulting loss except where required by law.
Limitation of Liability
Nothing in these Terms limits rights under the Australian Consumer Law. Subject to those rights GiveT:
- provides the Platform “as is” and makes no representations or warranties
- excludes all liability for indirect or consequential loss
- limits its total liability arising from your use of the Platform to the total amount of GiveT fees you paid in the three months prior to the claim.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
